MINNEAPOLIS, MN -- 02/11/08 --
On February 7, 2008, loan officers filed a
nationwide putative collective action
overtime lawsuit against American
Equity Mortgage. The suit was filed in the United States District Court
for the District of Minnesota. Plaintiffs allege that American Equity
Mortgage violated the federal Fair Labor Standards Act by misclassifying
its loan officers as exempt from
overtime pay. The suit was
started by former loan officers who worked for American Equity Mortgage in
Minnesota, Michigan, and Nevada on behalf of themselves and others
similarly situated.
Plaintiffs' attorney David Zoeller explained, "It appears that loan
officers in branches across the country were misclassified as exempt employees,
and were routinely denied overtime wages."
Plaintiffs are represented by Donald Nichols, Paul Lukas, Michele Fisher,
and David Zoeller from Nichols Kaster & Anderson, PLLP, which has offices
in Minneapolis, Minnesota and San Francisco, California. The case is
entitled Arneson et al v. American Equity Mortgage, Inc., et al, Civ. No.
0:08-cv-332, D. Minnesota.
