'In recognition of outstanding verdicts in connection with a jury trial' SAN DIEGO, Nov. 3
SAN DIEGO, Nov. 3 /PRNewswire/ -- The Consumer Attorneys of San Diego (CASD) organization will give out four Outstanding Trial Lawyer of the Year Awards in recognition of outstanding verdicts in connection with a jury trial to three attorneys at The Gomez Law Firm: John H. Gomez, Robert Hamparyan and James S. Iagmin at its annual Awards and Installation Dinner to be held at the U.S. Grant on October 29th.
According to CASD, the Outstanding Trial Lawyer of the Year Award is given to individuals based in San Diego, responsible for an outstanding verdict in connection with a jury trial involving a civil or criminal matter. The case must be tried to a verdict, read and reported in court as to some portion of the issues involved in the case. Other criteria include ingenuity, liability aspects, service to the community and the amount of the verdict.
John Gomez and James S. Iagmin will receive the award for the case of La Framboise v. Krebs, et al., which is the first case in California to apply the elder abuse statute to a commercial real estate transaction. The La Framboise family, after many years of working, purchased a building in downtown San Diego, which represented a good portion of the retirement funds for the elderly parents. They hired a commercial broker, who also represented the buyer, resulting in the elderly Framboises being paid less for the property than should have been the case. In this precedent-setting case, The Gomez Law Firm attorney obtained a jury verdict of over $1 million dollars.
John H. Gomez received the award a second time, along with Robert Hamparyan from The Gomez Law Firm for Young v. Hernandez, for which the attorneys obtained a $2.1 million verdict in federal court in a prisoner wrongful death case. Also trying the case was Thomas Luneau. The death of Johnny Young at Donovan State Penitentiary came about when Mr. Young, mentally ill, was taken down in a yard upon failing to follow the guards' instructions - dying minutes later. The autopsy findings were consistent with an applied chokehold. The guards denied holding his neck, and the defense claimed Mr. Young died of "excited delirium" brought about by a psychotic outburst. The Gomez Law Firm was able to obtain a $2 million wrongful death suit for his elderly mother; $100,000 were awarded to her for his pre-death pain and suffering.
