After photographing the public bus driver texting while driving, a passenger triggers an investigation and attracts the interest of New York personal injury attorneys.

New York, NY (PRWEB) November 11, 2009 - Right before New York's statewide new law banning people from texting while driving goes into effect, a city bus driver is photographed texting on his cell phone while driving with one hand, attracting interest of personal injury attorneys.

The photographer is reported by the New York Post to be a frightened passenger who was on the bus that was traveling through heavy traffic.

A transit spokesperson confirmed that bus drivers are not permitted to talk on a cell phone or text while they are driving.

Under the new law, anyone caught using mobile devices for reading, typing, and/or sending messages can be fined $150.

"I hope the fear of a fine will be more effective in dissuading people from texting than the risk of losing his job was for this driver," said David Perecman, a New York personal injury attorney with the Perecman law firm.

Seventeen other states also ban texting for all drivers besides New York. Personal injury attorneys consider New York one more victory for common sense and safety.

The NYC Transit Authority is investigating the incident.
