Federal Signal Continues Success in Defense of Hearing Loss Litigation

New York Appellate Court Affirms Dismissal of Claims in New York
OAK BROOK, Ill., June 25 /PRNewswire-FirstCall/ --- Federal Signal Corporation (NYSE: FSS), a leader in advancing security and well-being, today announced that the Appellate Division of the Supreme Court of the State of New York has affirmed a lower court's pretrial decision to dismiss, as a matter of law, claims filed by four New York firefighters. The Appellate Court held that plaintiffs' failure to warn claims against Federal Signal had no merit because any alleged risk of hearing loss caused by sirens was "open and obvious." Plaintiffs previously had abandoned their claims against Federal Signal based on allegations that Federal Signal sirens were defectively designed.
This development follows voluntary dismissals of all hearing loss cases filed against Federal Signal in Maryland, New Jersey, and Missouri during the past 14 months. Federal Signal remains a defendant in hearing loss cases filed in Philadelphia and Chicago. In Chicago, Federal Signal obtained a complete defense verdict in a consolidated trial involving 27 plaintiffs during 2008 and lost a jury trial during February 2009 involving the consolidated claims of nine firefighters. Federal Signal has filed a post-trial motion to reverse the 2009 verdict and plans to file further appeals regarding that verdict, if necessary.
