OAK BROOK, Ill., Nov. 30, /PRNewswire-FirstCall/ -- Federal Signal Corporation (NYSE: FSS), a leader in advancing security and well-being, announced today that a Philadelphia court entered judgments in its favor in the first two cases scheduled to be tried against it by a group of firefighters who allege the Company's sirens caused them hearing loss. The cases were filed over two years ago in the Philadelphia Court of Common Pleas, and the parties engaged in extensive pre-trial work. After the first jury had been chosen, and on the morning the first trial was set to begin, the plaintiffs withdrew their oppositions to the Company's motions for summary judgment, ending their cases. The Company agreed to pay $12,500, a nominal sum, to reimburse a portion of the plaintiffs' litigation expenses, and the plaintiffs agreed to waive any rights to appeal.

This latest development follows voluntary dismissals of all hearing loss cases filed against Federal Signal in Maryland, New Jersey, and Missouri during the past 18 months. Federal Signal also won a dismissal of similar hearing loss claims filed by four New York City firefighters, and that dismissal was affirmed by an appeals court earlier this year. Federal Signal remains a defendant in hearing loss cases filed in Philadelphia and Chicago. In Chicago, Federal Signal obtained a complete defense verdict in a consolidated trial involving 27 plaintiffs during 2008, and lost a jury trial in February 2009 involving the consolidated claims of nine firefighters. The Company is appealing that verdict. The claims of 74 other Cook County firefighter plaintiffs have also been dismissed over the course of the litigation.
