Fenner Investments is once again looking for its 15 minutes of fame, this time by suing console makers Microsoft, Sony and Nintendo, alleging that these three companies have stolen Fenner's ideas in the design of their joysticks.
Fenner Investments came into the limelight when it sued firms such as Alcatel, Cisco, and Nokia, saying that these three companies had used Fenner's plans during the design of communications network for mobile users. However the court dismissed the suit. Infact Fenner was lucky that it was not accused of filing frivolous lawsuits.
This time around, Fenner is accusing the three console makers of violating its copyrights by designing the joystick port interface in a method that has already been patented by it.
"Each of the Defendants' acts of infringement has caused damage to Fenner, and Fenner is entitled to recover from each Defendant the damages sustained by Fenner as a result of their individual wrongful acts in an amount subject to proof at trial," the lawsuit says.
"Each of the Defendants' infringement of Fenner's exclusive rights under the '751 Patent will continue to damage Fenner's business, causing irreparable harm, for which there is no adequate remedy at law, unless it is enjoined by this Court," it adds.
The three companies named in the suit were unavailable for comment.
