German court rules transsexual can be excluded from police

Frankfurt - The German state of Hesse was justified in excluding a transsexual from its police force, a court in Frankfurt ruled Tuesday on the basis of evidence from a police doctor. The court rejected argument from the applicant, a 36-year-old who changed gender from woman to man 14 years ago, that he had been subject to unjustified discrimination. The police doctor found that the applicant's hormone levels varied strongly and concluded that he could be subject to mood swings. The applicant is experienced in martial arts and has worked as a bodyguard. He passed the police entrance tests with flying colours. The case is to be taken to a higher court.

First of all a person can never change their gender...it is inborn. They can change or correct their sex to reflect what is, or at least should be, their mental gender.
This person is a male if he had the necessary corrections. But, if he is still producing female hormones and that was the reason for the denial then I would submit the person rather than being a post-operative male is still legally female. Opposite sex hormone introduction is the first stage of sex corrective needs and if still producing female hormones then full transition has not occurred.
If that is the case then I would agree with the determination. But, if actually had surgery to be male, even if limited as per acceptable standards, (all but construction of a working and viable penis) then I must disagree with the exclusion.
I am totally opposed to those who never had transition corrective surgery from making claim they are the opposite sex. That is transgender thinking and not transsexual actuality.
