Woman wins right to smoke in her garden

STOCKHOLM, Sweden, Sept. 14 Sweden's Environmental High Court has given the green light to a woman who wants the freedom to smoke in her own garden.

Last month an environmental court in southern Sweden ordered the unidentified woman to refrain from lighting up too close to her neighbor's hedge, The Local reported Friday.

The court intended the ban to be temporary while it decided how best to resolve the conflict between the woman and her neighbor, who is sensitive to cigarette smoke.

The court sent a delegation to the woman's home to investigate the matter in mid-August but she refused to cooperate.

"I thought it was crazy. What were they going to do here?" the woman said. "This is ridiculous."

The delegation instead went into the neighbor's yard and proceeded to draw detailed diagrams of the two gardens.

In her appeal, the woman contended a smoking ban had no basis in law and that it was a violation of her human rights.
