FALLS CHURCH, Va. - (Business Wire) The United States General Accountability Office (GAO) announced its ruling today in favor of DynCorp International's (NYSE:DCP) protest of the issuance of task order request for proposals (TORPs) by the Department of the Army for training and facilities support for the Ministry of Interior and Afghan National Police.
DynCorp International filed the protest in December of 2009 after learning the civilian police training contract would not be competitively bid. DynCorp International is the current incumbent providing highly-qualified and experienced law enforcement personnel to support civilian police training and mission support to the Afghan National Police. The current contract program, managed under the Department of State, is scheduled to transition to the Department of Defense later this year.
DynCorp protested the closed bidding process as well as the use of the Counter-Narcoterrorism Technology Program Office (CNTPO) contracting vehicle itself, which, as the GAO confirmed in its ruling today, was intended for technology acquisition, not civilian police training.
In a letter dated March 15, 2010, to the Secretary of the Army, Acting GAO General Counsel Lynn H. Gibson stated:
“We sustain the protest because we conclude that the TORPs are outside the scope of the ID/IQ contracts. We recommend that Army cancel the TORPs and either conduct a full and open competition for these services, or prepare the appropriate justification required by the CICA[Competition in Contracting Act of 1984] to limit the competition.”
